§ 1. General provisions
- These Terms and Conditions set out the rules for using the online shop at thesybinlabs.pl, including the rules for placing orders, making contracts of sale, making payments, delivery, making complaints, using the right to withdraw from a contract and using services provided electronically.
- The owner of the Shop and the seller is THESYBIN LABS PROSTA SPÓŁKA AKCYJNA, with its registered office at ul. Lubiejewska 158, 07-300 Ostrów Mazowiecka, Poland, entered in the National Court Register (KRS) under number KRS 0001130421, NIP (tax ID) 7162845553, REGON 529829000, email address: kontakt@thesybinlabs.pl.
- The Terms and Conditions are available free of charge on the Shop website in a way that lets you download, display and save them.
- The Customer must use the Shop in line with the applicable law, these Terms and Conditions and good practice.
- For services provided electronically, these Terms and Conditions are the terms for providing services electronically.
§ 2. Definitions
- The terms used in these Terms and Conditions mean:
- Seller – THESYBIN LABS PROSTA SPÓŁKA AKCYJNA;
- Shop – the online shop run by the Seller at thesybinlabs.pl;
- Customer – a natural person, a legal person or an organisational unit with legal capacity that uses the Shop or makes a contract with the Seller;
- Consumer – a natural person who carries out a legal transaction with a business that is not directly related to their business or professional activity;
- Business with consumer rights – a natural person who makes a contract directly related to their business activity, when the content of the contract shows that it is not of a professional nature for that person;
- Product – goods offered by the Seller in the Shop;
- Contract of sale – a distance contract for the sale of a Product made through the Shop;
- Account – an electronic service that lets the Customer create an individual profile in the Shop;
- Newsletter – an electronic service of sending information about the Shop, the offer or the activities of the Seller to the email address given;
- Working days – days from Monday to Friday, excluding public holidays.

§ 4. Technical requirements
- To use the Shop, you need:
- a device with Internet access;
- an up-to-date web browser;
- an active email address, if a function requires it;
- cookies and JavaScript turned on, if this is necessary for the Shop to work correctly.
- The Seller takes steps to make sure that the Shop works correctly, but does not guarantee that the website will work without breaks or completely without errors.
- The Customer must not provide unlawful content.
§ 5. Services provided electronically
- Through the Shop, the Seller provides the following services electronically:
- running an Account;
- making it possible to place an order through the order form;
- a contact form;
- the Newsletter.
- Using the order form and the contact form is free of charge.
- The contract for running an Account is made for an indefinite period when the Customer registers the Account.
- The Customer can delete the Account at any time by sending a request to the Seller’s email address.
- The contract for the Newsletter service is made for an indefinite period when the Customer signs up for the Newsletter.
- The Customer can unsubscribe from the Newsletter at any time by using the unsubscribe link in the email or by contacting the Seller.
- The Seller may temporarily suspend access to selected functions of the Shop for technical, maintenance or security reasons.
§ 6. Rules for using the Shop
- The Customer must provide data that is true.
- The Customer must not take any action that could disrupt the correct working of the Shop.
- Information about Products in the Shop is not an offer within the meaning of the Polish Civil Code, but an invitation to make a contract.
§ 7. Placing orders
- You can place orders in the Shop 24 hours a day, except during technical breaks.
- To place an order, the Customer:
- chooses a Product and adds it to the basket;
- goes to the order form;
- enters the required data;
- chooses a delivery and payment method from those available in the Shop;
- accepts the Terms and Conditions;
- confirms the order with the button that completes the purchase.
- By placing an order, the Customer makes an offer to the Seller to make a Contract of sale.
- After the order is placed, the Seller sends a confirmation that the order was received to the Customer’s email address.
- The Contract of sale is made when the Seller accepts the order for processing.
§ 8. Prices and payment methods
- The prices of Products shown in the Shop are in Polish zloty and are gross prices.
- The prices of Products do not include delivery costs, unless the Product description or the Shop says otherwise.
- Before placing an order, the Customer is informed about the total price of the order, including the price of the Products and the delivery costs.
- The available payment methods are shown in the Shop when you place an order.
- For payments made through an external payment operator, payments are handled in line with the rules of that operator.
- At the Customer’s request, the Seller issues a sales document in line with the applicable law.
§ 9. Order processing and delivery
- Order processing starts after the Seller receives confirmation of successful payment, unless the Shop also offers other forms of payment.
- Orders are delivered to the address given by the Customer when placing the order.
- The available delivery methods are shown in the Shop.
- The order processing time is shown in the Shop or when you place an order.
- If it is not possible to fulfil the order or part of it, the Seller will inform the Customer without delay and return the relevant part of the amount paid, if it has already been paid.
§ 10. Complaints about Products
- The Seller is responsible to the Consumer and to the Business with consumer rights for the Product being in line with the contract.
- If the Product is not in line with the contract, the Customer can make a complaint:
- electronically to kontakt@thesybinlabs.pl;
- in writing to the Seller’s address.
- The complaint should include data that identifies the Customer, a description of the problem and the request related to the complaint.
- The Seller replies to the complaint within 14 days from the day it is received.
- If the Product is not in line with the contract, the Consumer or the Business with consumer rights can ask for repair or replacement, and in the cases provided by law also for a price reduction or withdrawal from the contract.
- The Seller’s responsibility to the Consumer and to the Business with consumer rights for goods not in line with the contract lasts for 2 years from the day the goods are delivered, unless a longer period has been set for the Product.
- The Product with the complaint must be made available to the Seller if this is necessary to deal with the complaint.
- For Customers other than the Consumer and the Business with consumer rights, the Seller’s liability under the statutory warranty is excluded to the widest extent allowed by law.
§ 11. Complaints about services provided electronically
- The Customer can make complaints about how the Shop, the Account, the contact form or the Newsletter work by email to: kontakt@thesybinlabs.pl.
- The complaint should include data that identifies the Customer and a description of the problem.
- The Seller deals with the complaint within 14 days from the day it is received.
§ 12. Right to withdraw from the contract
- The Consumer and the Business with consumer rights have the right to withdraw from a distance Contract of sale within 14 days without giving a reason.
- The withdrawal period starts on the day when the Consumer, or a third party named by them who is not the carrier, takes possession of the Product. For an order with many Products delivered separately, in batches or in parts, it starts when the last Product, batch or part is received.
- To use the right to withdraw from the contract, send the Seller a clear statement:
- electronically to kontakt@thesybinlabs.pl, or
- in writing to the Seller’s address.
- To keep to the withdrawal deadline, it is enough to send the statement before the deadline ends.
- If the Customer withdraws from the contract, the Seller returns all payments received from the Customer, including the cost of delivering the Product up to the cost of the cheapest standard delivery method offered in the Shop, without delay and no later than 14 days from the day the Seller receives the statement of withdrawal.
- The Seller may hold back the refund until the Product is received back or until the Customer provides proof that it was sent back, whichever happens first.
- The refund will be made using the same payment method that the Customer used, unless the Customer clearly agrees to a different method.
- The Customer should send the Product back without delay, no later than 14 days from the day they withdrew from the contract.
- The Customer pays the direct cost of returning the Product, unless the Seller clearly says that the Seller will pay this cost.
- The Customer is responsible for any reduction in the value of the Product caused by using it more than is necessary to check the nature, features and working of the Product.
§ 13. Exceptions to the right to withdraw from the contract
- The right to withdraw from the contract does not apply in the cases provided by law, in particular for contracts:
- for services, if the service has been fully provided with the clear consent of the Consumer, who was informed before the start of the service that they would lose the right to withdraw from the contract;
- where the subject is a Product that is not prefabricated, is made to the Consumer’s specifications or is made to meet their individual needs;
- where the subject is a Product that goes off quickly or has a short use-by date;
- where the subject is a Product delivered in a sealed package that cannot be returned after opening for health protection or hygiene reasons, if the package was opened after delivery;
- where the subject is Products that, because of their nature, are inseparably mixed with other items after delivery.
§ 14. Personal data and cookies
- The Seller processes Customers’ personal data in line with the applicable law and the Privacy Policy available on the Shop website.
- The detailed rules for processing personal data, cookies and analytics tools are set out in the Privacy Policy.
§ 15. Out-of-court dispute resolution
- The Consumer can use out-of-court ways of dealing with complaints and claims, in line with the applicable law.
- Using out-of-court dispute resolution is voluntary.
§ 16. Final provisions
- Polish law applies to contracts made through the Shop.
- Matters not covered by these Terms and Conditions are governed by the relevant provisions of generally applicable law.
- The Terms and Conditions may be changed for important reasons, in particular if the law changes, the functions of the Shop change, the payment or delivery methods change, or the Seller’s details change.
- Orders placed before the new Terms and Conditions come into force are covered by the Terms and Conditions valid on the day the order was placed.
- The Terms and Conditions come into force on the day they are published in the Shop.
